Welcome to THANE.

Throughout these Terms of Service, the terms “THANE,” “we,” “us,” and “our” refer to THANE.

THANE operates this website and online store, including all associated information, content, features, tools, products and services made available to you (collectively, the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, explain your rights and responsibilities when accessing our website, purchasing our products, or otherwise using our Services.

By accessing, browsing, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms, you should not use our Services.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded, including rights available under the Australian Consumer Law.

Section 1 – Eligibility, Access and Account Information

By using our Services, you confirm that you are legally capable of entering into transactions through our store or are using the Services with the permission of a parent or legal guardian where required.

Measurements and sizing information are provided as a guide. Customers are responsible for reviewing the relevant size guide before purchasing.

Product availability, specifications, fabrics, colours, sizing and other product details may be changed or discontinued at any time.

Some THANE products may be produced, printed, prepared or fulfilled after an order is placed.

We reserve the right to limit product quantities, discontinue products or restrict sales to particular regions where reasonably necessary.

Nothing in this section limits your rights where a product fails to comply with applicable consumer guarantees.

Section 3 – Orders

When you submit an order through our store, you are making an offer to purchase the products listed in your order.

An order is not considered accepted until payment has been successfully processed and we have confirmed the order.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • payment cannot be processed;

  • a product is unavailable;

  • pricing or product information contains an obvious error;

  • fraud or unauthorised activity is suspected;

  • an order breaches these Terms; or

  • fulfilment of the order is not reasonably possible.

If we cancel an order after payment has been received, we will provide any refund required by law.

Please review your order carefully before completing checkout.

You are responsible for ensuring that the products, quantities, sizes, colours and shipping information entered at checkout are correct.

Purchases are also subject to our Return, Refund & Cancellation Policy.

Section 4 – Incorrect Size, Colour or Product Selection

Customers are responsible for reviewing product descriptions and sizing information before purchasing.

Where THANE supplies the exact product, size and colour selected by the customer and the product is otherwise free from defects, the selection of an incorrect size, colour or product is considered a customer selection error.

Eligible items may still be returned in accordance with our Return, Refund & Cancellation Policy.

Customers are responsible for applicable return shipping costs for change-of-mind or customer selection returns.

Nothing in this section affects rights available where the product supplied is faulty, incorrectly described or different from the product ordered.

Section 5 – Shipping Information and Incorrect Addresses

Customers are responsible for providing a complete and accurate shipping address at checkout.

If you discover an error in your address, you should contact us as soon as possible at support@thanemelbourne.com.

We will make reasonable efforts to update shipping information before fulfilment begins, but changes cannot be guaranteed once an order has entered production, fulfilment or shipping.

THANE cannot guarantee a refund, replacement or free reshipment where an order is lost, returned, delayed or incorrectly delivered because the customer supplied an incorrect or incomplete address.

If a parcel is returned because of an incorrect address supplied by the customer, additional shipping charges may apply before the item is resent.

This does not limit any rights you may have where the delivery issue was caused by THANE or where applicable law provides otherwise.

Section 6 – Cancellations

Cancellation requests may be submitted within 1 hour of placing an order, provided the order has not already entered production or fulfilment.

Because some products may enter production shortly after an order is placed, cancellation requests cannot be guaranteed.

To request a cancellation, contact returnrefunds@thanemelbourne.com as soon as possible and include your order number.

Once an order has entered production, fulfilment or shipping, we may be unable to cancel it.

Where cancellation is no longer possible, eligible products may be returned after delivery in accordance with our Return, Refund & Cancellation Policy.

Section 7 – Prices and Payment

All prices displayed on our website are shown in the currency indicated at checkout.

Prices, discounts and promotions may change at any time without notice.

The price charged will be the price displayed when your order is submitted, subject to correction of obvious pricing errors.

Shipping charges, taxes, duties or other applicable fees may be displayed separately where relevant.

You agree to provide accurate and authorised payment information.

By submitting payment details, you represent that you are authorised to use the payment method provided.

We reserve the right to refuse or cancel transactions that we reasonably suspect are fraudulent or unauthorised.

Section 8 – Shipping and Delivery

Delivery estimates displayed on our website are estimates only unless expressly stated otherwise.

Orders may be produced, fulfilled and shipped by third-party fulfilment and logistics providers acting on behalf of THANE.

Delivery times may be affected by production times, shipping carriers, customs processing, weather, peak periods, public holidays or circumstances outside our reasonable control.

We are not responsible for delays caused solely by events outside our reasonable control.

However, nothing in these Terms removes any rights you may have under applicable consumer law regarding delivery within a reasonable time.

Section 9 – Returns and Refunds

Returns, refunds and exchanges are governed by our Return, Refund & Cancellation Policy, which forms part of these Terms.

Our voluntary return policy operates in addition to, and does not replace, any rights you may have under Australian Consumer Law or other applicable consumer protection legislation.

Where a product has a major fault or otherwise fails to comply with applicable consumer guarantees, remedies will be provided as required by law.

Unless otherwise stated, all content available through THANE's Services, including our:

  • brand name;

  • logos;

  • product names;

  • product designs;

  • photography;

  • graphics;

  • website layout;

  • written content;

  • videos;

is owned by or licensed to THANE and is protected by applicable intellectual property laws.

You may use our website and its content for personal, non-commercial purposes only.

Without our prior written permission, you must not reproduce, copy, distribute, modify, republish, sell, exploit or commercially use our content.

Nothing in these Terms grants you ownership of THANE's trademarks, branding, designs or other intellectual property.

THANE is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make through our store are made directly with THANE.

By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and THANE, including any injury, damage or loss resulting from products purchased from THANE, except to the extent otherwise required by applicable law.

Because our store is hosted by Shopify, certain information may also be collected and processed by Shopify and other service providers involved in operating our store, processing payments, fulfilling orders and delivering products.

The remaining provisions will continue to apply.

A failure by THANE to enforce any provision of these Terms does not constitute a waiver of that provision.
